Supreme Court to Hear DACA Case

The Supreme Court of the United States announced that it will consider the legality of the Trump Administration’s efforts to curtail the Deferred Action for Childhood Arrivals (DACA) program.  Court consideration will come during the 2019-2020 term, which starts in October.

For purposes of review, the Court has consolidated three different cases in which federal judges have blocked the Administration from terminating the DACA program.  The cases are Department of Homeland Security v. Regents of the University of California; Trump v. NAACP; and McAleenan v. Vidal.  Several institutions of higher education have a direct stake in the Court’s decision. In addition to the University of California, Princeton University joined one of the underlying cases.

Due to deep political divisions on immigration, congressional action on DACA has been stalled for years. As a result, the fate of Dreamers has remained in limbo as these cases made their way through the judicial process. 

The Court’s agreement to hear the case could put additional political pressure on both parties in Congress to come to the table to negotiate a permanent solution for Dreamers.    

The higher education community is likely to weigh in on the Supreme Court case through an amicus brief.
