Nearly 40 Higher Education Associations Submit Amicus Brief to Supreme Court in Fisher Case

NAICU joined 37 other higher education organizations, led by the American Council on Education,in an
amicus brief submitted to the U.S. Supreme Court in the case of
Fisher v. University of Texas. The brief, submitted October 30, argues that colleges and universities have a compelling interest in the educational benefits of student diversity, and that interest justifies a narrowly tailored consideration of race in admissions. The court has upheld that interpretation in rulings beginning with the
Bakke case in 1978, and reaffirmed in
Grutter v. Bollinger in 2003, and in the court’s first decision in the
Fisher case in 2013. The next step will be oral arguments, with a decision expected by June 2016.
